1. 一般條款
1.1. 在本網上購物條款及細則及忘憂草寵物酒店特別條款(定義見下)(統稱「本條款及細則」)中,「忘憂草」或「我們」是指忘憂草之業務,而「客戶」或「您」是指任何在我們訂購貨品或服務的個人、機構或公司。請在使用本網頁或我們的應用程式(統稱「電子商店」)之前仔細閱讀本條款及細則。閣下使用電子商店或其中任何部分,即表示同意閣下已閱讀本條款及細則,並且接受和同意受本條款及細則所約束。
1.2. 我們會盡一切努力確保電子商店上所列載的貨品價格、資料和大小均已更新。我們保留權利可更改貨品的價格而不作另行通知。我們可根據存貨供應,全權決定是否接受所有訂購。
1.3. 我們會盡一切努力確保電子商店上所列載的貨品提供存貨供應。如任何貨品因缺貨而未能提供予顧客,我們有權提供相同種類及價格的貨品以供替代。
1.4. 所有訂單須視乎相關貨品的供應情況再作最後確認。倘若我們未能提供任何已訂購之產品或服務,我們有權拒絕接受該訂單。
2. 用戶登記
2.1. 您須(在網上或以其他方式)進行登記成為我們的用戶,方可於電子商店訂購貨品或服務。在登記時,即代表您承諾:
按要求提供有關您個人的真實、準確、最新及完整的資料;
您須確保妥善保存您的用戶名稱及密碼;
只有您或您授權的人士使用閣下的用戶名稱及密碼登入電子商店;
我們有絕對酌情權拒絕任何新用戶之申請及終止任何已登記之用戶,而無須提供任何理由。
2.2. 如您已登記的資料有任何更改,您可登入您的賬戶更新或以電話或電郵立即通知我們,以確保我們能夠將最新的資訊帶給閣下。
2.3. 如您的賬戶在一段特定時間內一直沒有使用(目前為2年),為了保護您及我們,我們將視為您不再使用該賬戶,並使其失效。閣下賬戶內的所有積分及/或電子優惠券亦會被取消(如適用)。如您希望再次在電子商店購物,您須重新申請一個新賬戶。
3. 保障私隱
為致力保障您的個人資料的私隱權利,我們確保在收集、使用、保留、轉移及查閱個人資料方面的政策及常規,均符合香港法例第486章個人資料(私隱)條例的規定。請查看我們的私隱政策聲明。
3.1. 有關使用您的個人資料
您同意我們可使用及保存您向我們提供的有關個人資料,及您在使用我們的網站及/或我們的應用程式的資料,以作:
3.1.1 處理您的登記客戶之申請; 3.1.2 向您提供我們的服務; 3.1.3 我們的網站及/或我們的應用程式的正常管理、運作及保養; 3.1.4 向您提供定期信息,包括我們的零售業務及相關獎賞的詳情; 3.1.5 向您提供您要求的零售產品或服務; 3.1.6 處理我們之商店的購入訂單,包括驗證您的付款詳情/狀態; 3.1.7 進行您有參與的抽獎、遊戲或比賽; 3.1.8 進行數據排序及分析,使我們能理解您的特點及購買行為,向您提供更符合您需要的其他服務、協助我們挑選您可能感興趣的零售產品或服務; 3.1.9 我們、我們的聯營公司及/或我們的附屬公司向您設計及提供的新服務,或改善現有服務; 3.1.10 調查投訴、備受懷疑的可疑交易及研究服務改善措施; 3.1.11 防止及偵測罪行; 3.1.12 根據法例作出披露;及 3.1.13 綜合性行為分析。
3.1.14 我們可能披露及轉移(無論在香港或海外)您的個人資料予向我們負有保密責任的代理人、承辦商,以向我們提供管理、數據分析、市場推廣及研究、專業服務或其他類似的服務。
3.3.15 資料之查閱與刪除
(1) 會員能隨時在網站的會員帳號查看授權的姓名與電郵資料,並且僅作為商店會員、訂單資料的內容。 (2) 商店依照本人請求,可透過商店的聯絡管道提出刪除、停止使用該個人資料的要求。
您擁有隨時查詢、閱覽、修改個人在本網站的會員帳號資料。當您想要刪除個人在本網站的會員帳號或是反對我們的行銷團隊使用您的個人資料時,請透過忘憂草客服信箱和我們聯繫,我們將在收到訊息20天內回覆您。忘憂草客服信箱:daylilyhongkong@gmail.com。
4. 付款方式
4.1. 電子商店接受我們所指定的信用卡或其他指定的電子支付方式付款,所有貨品之價值均以港幣計算。電子商店的貨品價格有可能與我們的實體店鋪有所出入,貨品以訂購當日電子商店所示之價格為準。
4.2. 所有網上訂購的貨品須由我們全權決定並根據存貨供應而接受。閣下將於收取貨品(於送貨或實體店鋪自取)時收到最終的購物收據以作記錄。
4.3. 為提供安全可靠的網上購物服務,電子商店的交易使用安全通訊協定Secure Sockets Layer (SSL)。所有個人資料包括您的信用卡號碼、姓名、地址等,會經過加密,才透過互聯網傳送,防止您的資料在網上傳送時,被未經許可的第三者閱讀。如要檢查安全憑證的資料,您可於結賬時按滑鼠右鍵,然後選擇「內容」及「憑證」。
5. 其他
5.1. 供貨的基礎:我們僅向最終消費者銷售和運送產品。我們不會銷售我們的產品用於作轉售用途。如果我們有合理的依據認為您購買我們的產品並非作為自用,我們有權拒絕或取消您的訂單。
5.2. 不可抗力:我們倘若由於不可抗力的原因(包括由於天災、火災、水災、意外、暴亂、戰爭、政府政策、禁運、罷工、勞動困難、設備故障或任何我們不能控制的情況)而未能準確地提供閣下所需的產品或服務,我們均不會向使用者或任何第三者承擔任何責任。
5.3. 未得我們發出書面同意之前,您不可將本條款及細則的任何權利及責任以分配、轉送或任何其他形式轉讓給任何其他人等。
5.4. 若本條款及細則其中任何條款被解釋為非法或無效,該等條款將被删除及不影響本條款及細則其他條款的合法性、有效性及可執行性。
5.5. 本條款及細則包含了雙方的全部協議,其亦取替所有之前之商議、聲言、共識及協議。
5.6. 我們有權隨時修改、更改或補充所有或本條款及細則項下的任何條款而不作另行通知。
5.7. 如有任何爭議,我們保留最終的決定權。本條款及細則以中文為準。
5.8. 本條款及細則將按照中華人民共和國香港特別行政區法律詮釋,而你及我們同樣受香港法院所管轄。我們可能不時對本條款及細則作出更正修改而不向您作預先通知。
忘憂草特別條款(“特別條款”)
這些特別條款為上述網上購物條款及細則的補充,適用於您在電子商店的訂單。如有歧義,以忘憂草特別條款為準。
6. 忘憂草的付款條件
6.1. 我們接受Visa、MasterCard、銀聯卡或PayPal付款。
註:輸入信用咭號碼時,毋須輸入空格或破折號。
6.2. 忘憂草現金券與會員卡:電子商店不接受由忘憂草所發出的實體現金禮券和會員卡優惠。
6.3. 電子優惠券與電子折價券:我們只接受指定之電子優惠券或電子折價券,並按照相關條款及細則,於電子商店以作換購產品或折扣之用。
6.4. 如果有額外的送貨費用,這些費用將會聯絡您另行進行確認。
7. 訂購須知
7.1. 電子商店只接受在香港的指定送貨的帳單地址,或實體店自行取貨的訂單。
7.2. 您向我們訂購產品時,即表示您同意按照本條款及細則向我們提出購物請求。收到您的訂單之後,我們將通知您並確認收到該訂單。該回覆並不代表我們已經接受您的訂單。倘若我們未能提供任何已訂購之產品或服務,或因您所使用的信用咭導致之付款問題或任何其他原因,我們有權拒絕接受該訂單。倘若我們無法提供閣下訂單上的任何產品或服務,我們會透過電話或電郵通知閣下。
7.3. 閣下的訂購請求獲我們接受後,我們會與您確認接受訂單,並同時通知您送貨 / 在指定實體商店自行取貨的時間和日期。
7.4. 如您所訂購貨品所附送之贈品已經送完,我們將會通知您有關情況。閣下有權接受我們建議之另一贈品、選擇取消訂單或繼續購買該產品。
8. 送貨服務(適用於選擇將訂單送往指定的送貨地址)
8.1. 每次於電子商店購物金額滿港幣299元或以上,您可免費享用送貨服務(詳情載於發票內)。
8.2. 送貨服務僅限於固定地址,服務範圍暫包括香港島和九龍。請致電忘憂草寵物酒店查詢有關送貨服務安排之詳情。
8.3. 送貨服務不適用於非固定地址、邊境禁區、新界、離島、貨倉、唐樓、不能經升降機送貨而需經由露台入屋之地點。
8.4. 當您於電子商店提交訂單後,如訂單獲我們接受,我們將會與您確認預計送貨時間及日期。貨物抵達前將由送貨員致電通知,請您點收訂購了的貨品是否齊全,並由收件人在送貨單上寫上姓名及簽名確認收取貨品。
8.5. 若懸掛八號颱風訊號或黑色暴雨警告,我們將盡力安排下一個工作天送貨。
8.6. 一般情況下,我們會於下午6時至下午11時送貨到您的指定送貨地址。工作天不包括星期六、星期日及公眾假期。
請注意,所有貨品將盡我們最大能力按計劃交付。
此服務可能會因季節性因素(例如大型銷售活動期間)或節日 (例如聖誕節、農歷新年或復活節) 而有所影響。
8.7. 如果您因在首次約定的送貨預約時失約或因您提供不準確地址而導致您未能收取您訂購的產品,我們會(i)就其後的送貨預約保留向您收取額外送貨費用的權利或(ii)安排您到我們的門市直接取貨。
8.8. 所有送貨日期和時間均為預計送貨日期和時間。就您可能因為送貨延誤所可能造成的損失或損害,忘憂草恕不負任何責任。
8.9. 如有任何爭議,我們保留最終的決定權。
9. 店鋪自取服務(適用於已經選擇在實體店自行收取之訂單)
9.1. 每次於電子商店購物任何金額,您方可享用店鋪自取服務(詳情載於發票內)。當您訂購的產品已準備好可供收取時,我們會通過手機短信或電子郵件通知您。
9.2. 請您按照在電子商店所選日期,於14日內於營業時間期間前往收取已購買之產品。
9.3. 當您在實體店領取產品時,您或您的授權代表須向我們展示在確認您的訂單之電子郵件或手機短信,以進行身份驗證。我們可能需要您提供進一步的資料來驗證您的身份(例如您的全名或您的帳戶下的其他個人資料)。如果我們不能證實要求收取貨品的人是您本人或您的授權代表,我們將拒絕該人士收取您的訂單,以保障您的利益。
9.4. 如店鋪因天氣及其他因素影響下而停止營業,您可於翌日前往該店鋪領取產品。
10. 換貨及退款
10.1. 我們向您提供「14天的產品質量保證」,即於收貨時,若閣下發現產品損壞或並非處於良好狀況,可於14天內聯絡忘憂草以安排更換產品。否則一般情況下,我們不接受任何換貨或取消訂單的要求。
10.2. 如果我們同意你有權更換產品,但所要求更換之貨品已經售罄,我們會退回相關款項給您。
10.3. 在我們獨立決定及特殊情況下,我們將退回網上購物所涉及之款項到您的銀行户口或到店鋪取回款項。
10.4. 如您於付款時曾經使用電子優惠券或電子折價券,我們將會作出相關調整。
10.5. 在接受產品交換之前,請向我們出示購物收據正本或相關的電子收據。
10.6. 貨品必須與所有購買時所附送之贈品一併退還,否則我們將從退款中扣除該贈品的價值。
11. 其他
11.1. 直至顧客清付購買產品之全部款項,我們將保留擁有有關產品之物權,而相關之風險將於有關產品送交予顧客之同時視作已轉交予顧客。
11.2. 我們有權銷毀訂單確認通知日期超過30天仍未收取的貨品,而毋須另行通知。在此情況下,我們不會向您退款或賠償; 我們保留繼續向您索取存儲費用的權利。
11.3. 無論在任何情況下,您因與我們之間的交易而引致任何收入損失(不論直接或間接)、利潤或任何間接或後遺損失,我們概不負責。

**Online Shopping Terms and Conditions**
**1. General Terms**
1.1. In these Online Shopping Terms and Conditions and Daylily Pet Hotel Special Terms (defined below) (collectively, the “Terms and Conditions”), “Daylily” or “we” refers to the business of Daylily, and “Customer” or “you” refers to any individual, organization, or company ordering goods or services from us. Please carefully read these Terms and Conditions before using this website or our application (collectively, the “Online Store”). By using the Online Store or any part thereof, you acknowledge that you have read these Terms and Conditions and agree to be bound by them.
1.2. We will make every effort to ensure that the prices, details, and sizes of goods listed on the Online Store are up to date. We reserve the right to change the prices of goods without prior notice. We may, at our sole discretion, decide whether to accept orders based on stock availability.
1.3. We will make every effort to ensure the availability of goods listed on the Online Store. If any goods are unavailable due to stock shortages, we reserve the right to provide substitute goods of the same type and price.
1.4. All orders are subject to the availability of the relevant goods. If we are unable to provide any ordered products or services, we reserve the right to reject the order.
**2. User Registration**
2.1. You must register (online or otherwise) as our user to order goods or services from the Online Store. By registering, you agree to:
- Provide true, accurate, current, and complete information about yourself as requested;
- Ensure the safekeeping of your username and password;
- Ensure that only you or your authorized persons use your username and password to access the Online Store;
- We reserve the absolute discretion to reject any new user application or terminate any registered user without providing any reason.
2.2. If any of your registered information changes, you may update it by logging into your account or immediately notify us by phone or email to ensure we can provide you with the latest information.
2.3. If your account remains inactive for a specific period (currently 2 years), we will consider it unused and deactivate it to protect you and us. All points and/or electronic vouchers in your account will also be canceled (if applicable). If you wish to shop on the Online Store again, you must apply for a new account.
**3. Privacy Protection**
To protect your personal data privacy, we ensure that our policies and practices regarding the collection, use, retention, transfer, and access of personal data comply with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. Please review our Privacy Policy Statement.
3.1. Use of Your Personal Data
You agree that we may use and retain the personal data you provide to us and data collected from your use of our website and/or application for the following purposes:
3.1.1 Processing your application for customer registration;
3.1.2 Providing our services to you;
3.1.3 Normal management, operation, and maintenance of our website and/or application;
3.1.4 Providing you with regular updates, including details of our retail business and related rewards;
3.1.5 Providing retail products or services you request;
3.1.6 Processing purchase orders, including verifying your payment details/status;
3.1.7 Conducting lucky draws, games, or competitions in which you participate;
3.1.8 Performing data analysis to understand your characteristics and purchasing behavior, enabling us to provide tailored services and recommend retail products or services that may interest you;
3.1.9 Designing and providing new services or improving existing services by us, our affiliates, and/or subsidiaries;
3.1.10 Investigating complaints, suspected transactions, and researching service improvements;
3.1.11 Preventing and detecting crimes;
3.1.12 Making disclosures as required by law; and
3.1.13 Conducting aggregated behavioral analysis.
3.1.14 We may disclose and transfer your personal data (whether in Hong Kong or overseas) to agents or contractors bound by confidentiality obligations to provide us with administrative, data analysis, marketing, research, professional, or similar services.
3.1.15 Data Access and Deletion
(1) Members can view authorized name and email information in their account on the website, which is used solely for store membership and order details.
(2) Upon your request, the store may delete or cease using your personal data through our contact channels.
You have the right to access, review, or modify your account information on our website at any time. If you wish to delete your account or object to our marketing team using your personal data, please contact us via the Daylily customer service email, and we will respond within 20 days of receiving your request. **4. Payment Methods**
4.1. The Online Store accepts payments via specified credit cards or other designated electronic payment methods, with all prices calculated in Hong Kong Dollars. Prices on the Online Store may differ from those in our physical stores, and goods are priced as displayed on the Online Store on the order date.
4.2. All online orders are subject to our acceptance based on stock availability. You will receive a final purchase receipt upon receipt of goods (via delivery or in-store pickup).
4.3. To ensure secure online shopping, transactions on the Online Store use the Secure Sockets Layer (SSL) protocol. All personal data, including your credit card number, name, and address, is encrypted before transmission over the internet to prevent unauthorized access. To check security certificate details, right-click during checkout and select “Properties” and “Certificates.”
**5. Miscellaneous**
5.1. Basis of Supply: We sell and deliver products only to end consumers. We do not sell products for resale. If we reasonably believe you are purchasing our products for resale, we reserve the right to reject or cancel your order.
5.2. Force Majeure: We shall not be liable to you or any third party for failure to provide products or services due to force majeure events (including natural disasters, fires, floods, accidents, riots, wars, government policies, embargoes, strikes, labor issues, equipment failures, or other circumstances beyond our control).
5.3. Without our prior written consent, you may not assign, transfer, or otherwise delegate any rights or obligations under these Terms and Conditions to any other person.
5.4. If any provision of these Terms and Conditions is deemed illegal or invalid, such provision will be deleted without affecting the legality, validity, or enforceability of the remaining provisions.
5.5. These Terms and Conditions constitute the entire agreement between the parties, superseding all prior discussions, representations, understandings, and agreements.
5.6. We reserve the right to amend, modify, or supplement any or all provisions of these Terms and Conditions at any time without prior notice.
5.7. In case of any dispute, we reserve the final decision. These Terms and Conditions are governed by the Chinese version.
5.8. These Terms and Conditions shall be interpreted in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, and both you and we are subject to the jurisdiction of Hong Kong courts. We may amend these Terms and Conditions from time to time without prior notice.
**Daylily Special Terms (“Special Terms”)**
These Special Terms supplement the above Online Shopping Terms and Conditions and apply to orders placed on the Online Store. In case of any conflict, the Daylily Special Terms shall prevail.
**6. Daylily Payment Terms**
6.1. We accept payments via Visa, MasterCard, UnionPay, or PayPal.
*Note: When entering credit card numbers, do not include spaces or dashes.*
6.2. Daylily Cash Vouchers and Membership Cards: The Online Store does not accept physical cash vouchers or membership card discounts issued by Daylily.
6.3. Electronic Vouchers and Discount Codes: We only accept designated electronic vouchers or discount codes, subject to their respective terms and conditions, for product redemption or discounts on the Online Store.
6.4. If additional delivery fees apply, we will contact you for confirmation.
**7. Ordering Information**
7.1. The Online Store only accepts orders with billing addresses in Hong Kong for designated delivery or in-store pickup.
7.2. By placing an order, you agree to submit a purchase request in accordance with these Terms and Conditions. Upon receiving your order, we will notify you to confirm receipt. This confirmation does not indicate acceptance of your order. We reserve the right to reject an order if we cannot provide the ordered products or services, if there are payment issues with your credit card, or for any other reason. If we cannot fulfill any products or services in your order, we will notify you via phone or email.
7.3. Once your order is accepted, we will confirm acceptance and notify you of the delivery or in-store pickup time and date.
7.4. If promotional gifts included with your ordered goods are out of stock, we will inform you. You may choose to accept an alternative gift, cancel the order, or proceed with the purchase.
**8. Delivery Service (Applicable to orders delivered to a specified address)**
8.1. For purchases of HK$299 or more on the Online Store, you may enjoy free delivery service (details provided on the invoice).
8.2. Delivery service is limited to fixed addresses, covering Hong Kong Island and Kowloon only. Please contact Daylily Pet Hotel for details on delivery arrangements.
8.3. Delivery service does not cover non-fixed addresses, restricted border areas, the New Territories, outlying islands, warehouses, tenement buildings, or locations requiring delivery via balconies due to lack of elevator access.
8.4. Upon order acceptance, we will confirm the estimated delivery time and date. The delivery personnel will contact you before arrival. Please verify that all ordered goods are complete, and the recipient must sign the delivery note to confirm receipt.
8.5. In case of Typhoon Signal No. 8 or Black Rainstorm Warning, we will endeavor to arrange delivery on the next working day.
8.6. Generally, deliveries are made to your specified address between 6:00 PM and 11:00 PM on working days, excluding Saturdays, Sundays, and public holidays.
*Note: We will make every effort to deliver goods as scheduled, but delivery may be affected by seasonal factors (e.g., major sales events) or holidays (e.g., Christmas, Lunar New Year, or Easter).*
8.7. If you fail to receive the goods due to missing the first scheduled delivery or providing an inaccurate address, we reserve the right to (i) charge additional delivery fees for subsequent attempts or (ii) arrange for in-store pickup.
8.8. All delivery dates and times are estimates. Daylily shall not be liable for any loss or damage due to delivery delays.
8.9. In case of any dispute, we reserve the final decision.
**9. In-Store Pickup Service (Applicable to orders selected for in-store pickup)**
9.1. For any purchase amount on the Online Store, you may use the in-store pickup service (details provided on the invoice). We will notify you via SMS or email when your products are ready for collection.
9.2. Please collect your purchased products within 14 days of the selected date during business hours.
9.3. When collecting products in-store, you or your authorized representative must present the order confirmation email or SMS for verification. We may require additional information (e.g., your full name or other account details) to verify your identity. If we cannot verify that the person collecting is you or your authorized representative, we will refuse collection to protect your interests.
9.4. If the store is closed due to weather or other factors, you may collect your products the following day.
**10. Exchange and Refund**
10.1. We offer a “14-day product quality guarantee.” If you find the product damaged or not in good condition upon receipt, you may contact Daylily within 14 days to arrange a replacement. Otherwise, we generally do not accept exchange or cancellation requests.
10.2. If we agree you are entitled to a replacement but the requested product is sold out, we will refund the relevant amount.
10.3. In exceptional cases and at our sole discretion, we may refund online purchase amounts to your bank account or for in-store collection.
10.4. If you used electronic vouchers or discount codes for payment, we will make appropriate adjustments.
10.5. Before accepting a product exchange, please present the original purchase receipt or relevant electronic receipt.
10.6. Goods must be returned with all accompanying promotional gifts; otherwise, the value of the gifts will be deducted from the refund.
**11. Miscellaneous**
11.1. We retain ownership of the products until full payment is received, and the risk of the products transfers to you upon delivery.
11.2. We reserve the right to destroy uncollected goods 30 days after the order confirmation date without further notice. In such cases, no refunds or compensation will be provided, and we reserve the right to charge storage fees.
11.3. Under no circumstances shall we be liable for any loss of revenue (direct or indirect), profits, or any indirect or consequential losses arising from transactions with us.
